What You Should Do If You’ve Been Accused of a Crime

If you’ve been accused of a crime, especially a serious crime, it’s understandable to be stressed about it, even if you’re innocent. It’s important to note that being suspected of a crime doesn’t mean you’re going to be arrested. It’s up to the police to build a case that shows that a crime occured and that you’re the perpetrator. 

But this doesn’t mean you should sit back and relax.

Get a Lawyer

The first thing you should do if you become involved in an investigation is to contact a lawyer. Getting in touch with a lawyer doesn’t mean you’re automatically guilty or that you’re trying to slow the case down. You are simply protecting yourself, and your lawyer’s job is to make sure that your rights are protected. 

You also shouldn’t just pick any lawyer. You need a lawyer who is appropriate for your situation and your case. This might be a general criminal defence lawyer, but you can also find lawyers who specialize even further, like sexual offence lawyers. If you’re able to narrow it down, you will get a better lawyer for the job.

Most importantly, you should be honest with your lawyer and follow their advice. Their job is to defend your case, not to judge you themselves. So tell them anything that’s relevant, answer questions about your case honestly, and follow their advice.

Cooperate With the Authorities

One common misconception is that getting a lawyer isn’t cooperating with the police. It is. You’re following the law.

However, while you have the legal prerogative to know your rights and follow them, including remaining silent if you’re questioned by police, you should still cooperate with legal orders. There are some questions that you should answer, including your name and address. 

This is why it’s important to seek legal counsel as soon as possible, so you know exactly what your rights are.

Managing Stress

If you’re involved in an active investigation, and especially if you’re a primary suspect, it makes sense that you might be stressed about it. While the investigation might be something you need to focus on, it’s still important to find healthy ways to handle your stress.

This is vital because, when we’re stressed, we might make poor choices and become more snappish. But when you’re dealing with police, you need to be calm and reasonable. This will help you to navigate the investigation better.

If the investigation hinders your life in ways that overstretch the law, you should tell your lawyer. This is especially important in some more inflammatory cases, as even if you’re proven innocent, your reputation could still be damaged if the investigation was handled poorly.

Going to Court

If the case goes to court and you’re tried, your lawyer will be your primary defence, which means that you shouldn’t talk unless you’re directly addressed. When you are asked questions, be straightforward, clear, and respectful. Make sure to dress well and present yourself respectfully. Don’t engage with anyone else in the courtroom.
